Bollywood superstar Salman Khan has withdrawn his insolvency petition against equipment manufacturer Jerai Fitness Pvt Ltd, following a settlement between the two parties over a ₹7.24 crore payment dispute. The disagreement stemmed from issues related to Khan’s fitness equipment brand, Being Strong.
The settlement was confirmed before the National Company Law Appellate Tribunal (NCLAT) on Wednesday, with Justice Ashok Bhushan presiding over the matter.
### Background of the Dispute
The conflict originated from a trade license agreement signed in October 2018 between Being Strong and Jerai Fitness. This agreement authorized Jerai Fitness to use the “Being Strong” trademark on its manufactured products.
However, due to widespread business disruptions caused by the COVID-19 pandemic, Khan revised the royalty payments due to him until March 31, 2023, as per Jerai’s request. When Jerai allegedly failed to meet those payment obligations, Salman Khan issued a demand notice on September 14, 2024.
### Jerai Fitness’s Counterclaim
Jerai Fitness countered Khan’s claim by stating there was an existing dispute prior to the insolvency petition. The company highlighted its significant investments in developing components for new product lines such as the “X-tend” and “Proton series.”
According to Jerai, the issues largely stemmed from challenges on Being Strong’s side, complicating the payment and business relationship.
### NCLAT’s May Verdict
In May, the Mumbai bench of the NCLAT dismissed Salman Khan’s insolvency plea against Jerai Fitness. The tribunal ruled that Jerai had the right to manufacture and sell products under the “Being Strong” trademark.
The NCLAT clarified that Jerai Fitness was permitted to “manufacture, market, distribute, [and] sell” products using the “Being Strong” brand and create promotional materials featuring the trademark.
However, the tribunal emphasized that all major decisions related to product manufacture, promotion, marketing, and distribution required prior approval from Salman Khan or his authorized representative, Alvira Agnihotri.
The tribunal also noted that the payment claim was disputed in nature and should be pursued through recovery proceedings rather than insolvency.
### Current Status
Following the dismissal, Salman Khan challenged the tribunal’s decision but has now opted to settle the dispute amicably. The withdrawal of the insolvency petition marks a significant step toward resolving the conflict between Salman Khan and Jerai Fitness Pvt Ltd.
This settlement brings an end to a prolonged legal battle and allows both parties to move forward with their business interests.
