**Supreme Court Declines to Revisit Landmark Same-Sex Marriage Precedent**

*By John Fritze | CNN.com | November 10, 2025*

The Supreme Court on Monday declined an opportunity to overturn its landmark precedent recognizing a constitutional right to same-sex marriage, dismissing an appeal that had stirred concern among LGBTQ advocates. Many feared the conservative court might be poised to revisit the decade-old decision.

Instead, the court denied an appeal from Kim Davis, the former Kentucky county clerk who now faces hundreds of thousands of dollars in damages and legal fees for refusing to issue marriage licenses after the court’s decision in *Obergefell v. Hodges* allowed same-sex couples to marry.

The Supreme Court did not provide an explanation for its decision to deny the appeal. The case had attracted significant attention, partly because the court’s 6-3 conservative majority three years ago overturned *Roe v. Wade*, eliminating the constitutional right to abortion established by the 1973 decision.

Since then, concerns about *Obergefell* being the next precedent to fall have grown. The current Supreme Court is markedly different and more conservative than the one that decided *Obergefell* in 2015, which heightened LGBTQ advocates’ apprehension regarding the Davis appeal.

Despite these fears, the court’s decision to leave *Obergefell* intact signals continued recognition of same-sex marriage as a constitutional right.
